A (IM)POSSIBILIDADE DA DESCRIMINALIZAÇÃO DO ABORTO ATÉ O TERCEIRO MÊS DE GESTAÇÃO

Resumo
O presente artigo tem como objeto verificar a (im)possibilidade da descriminalização do aborto até o terceiro mês de gestação. A pesquisa trará uma análise pormenorizada do Habeas Corpus n° 124.306, julgado pelo Supremo Tribunal Federal (STF), que permitiu o feticídio até o primeiro trimestre de gestação. Ainda, com o fim de buscar resultado mais seguro a pesquisa, além da análise do referido remédio constitucional, também será perquirido o direito comparado, com enfoque especial em como o tema é tratado em outros países. Ao final, será apresentada a ADPF n° 442, que até o presente momento está em pendente de julgamento pelo STF, contudo, que visa dar caráter vinculante a matéria, isto é, que visa tornar ato lícito o abortamento até o terceiro mês de gestação. Para o presente Artigo foi utilizado o método de abordagem indutivo, o método de procedimento monográfico e a técnica de pesquisa bibliográfica. Nas considerações finais abordar-se-á a parte principal do tema, mostrando a comprovação total, parcial ou não comprovação da hipótese básica apresentada na introdução deste Artigo.

Abstract
This article aims to verify the (im)possibility of decriminalizing abortion up to the third month of pregnancy. The research will bring a detailed analysis of Habeas Corpus n° 124.306, judged by the Federal Supreme Court (STF), which allowed feticide until the first trimester of pregnancy. Still, in order to seek a more secure result of the research, in addition to the analysis of the aforementioned constitutional remedy, comparative law will also be investigated, with a special focus on how the subject is treated in other countries. At the end, ADPF n° 442 will be presented, which until the present moment is pending judgment by the STF, however, which aims to make the matter binding, that is, which aims to make abortion licit until the third month of pregnancy . For this Article, the inductive approach method, the monographic procedure method and the bibliographical research technique were used. In the final considerations, the main part of the theme will be approached, showing the total, partial or non-confirmation of the basic hypothesis presented in the introduction of this Article
