O ESTUDO POR MEIO DA LEITURA COMO INSTRUMENTO DE REMIÇÃO DA PENA NO BRASIL E ALTERNATIVA DE REINSERÇÃO SOCIAL DE PESSOAS EM SITUAÇÃO DE PRIVAÇÃO DE LIBERDADE

Resumo

O presente trabalho tem por objetivo descrever e analisar o entendimento doutrinário predominante acerca da remição da pena por estudo mediante a leitura. Problematiza, via reflexão, a prática da leitura enquanto método alternativo de redução da crise carcerária no Brasil, visto que a Lei 7.210, de 11 de julho de 1984, a Lei de Execução Penal, é omissa a este respeito. A referida lei prevê apenas a remição da pena por meio do trabalho e do estudo. Parte-se do pressuposto de que a educação penitenciária precisa ser vista como ferramenta primordial para a superação das violações de direitos no interior da prisão, bem como de reinserção do apenado pela capacidade de agregar valores éticos e morais à sua formação. Para a composição deste artigo, foi utilizado o método indutivo, tanto na fase de investigação, na forma de pesquisa bibliográfica, quanto na apresentação dos seus resultados.

Abstract

The following article has the goal to describe and analyze the predominant doctrinaire understanding about remission of crime sentence by reading. It problematizes, via reflection, the practice of reading as an alternative method of reducing the prision crisis in Brazil, considering that the law nº 7.210 of 1984 July 11, the Law of Penal Execution, is silent in this regard. The law only provides the remission of the sentence through work and study. It starts from the assumption that the prison education must be seen as a key tool for overcoming rights violations inside the prison and reintegration of the convict by the ability to add ethical and moral values to their training. The reserach method used for the preparation of this article was the inductive method, both in the research phase, in the form of literature, and in the presentation of its results.
