A QUESTÃO DO BULLYING NO AMBIENTE ESCOLAR E O PARADIGMA DA JUSTIÇA RESTAURATIVA COMO POSSIBILIDADE DE PREVENÇÃO E COMBATE A ESSA VIOLÊNCIA ESPECÍFICA CONTRA CRIANÇAS E ADOLESCENTES

Resumo
O presente artigo tem a pretensão de refletir sobre a questão do bullying dentro do ambiente escolar e o paradigma da Justiça Restaurativa como possibilidade de prevenção e combate a essa violência específica contra crianças e adolescentes. Trata-se de um tema transnacional, considerando que é observado em praticamente todas as escolas do globo. Inclusive, como será visto, o tema foi objeto de estudo científico, inicialmente, a partir da Suécia e Noruega, neste último, com destaque para o pesquisador Dan Olweus. Da mesma forma no que tange a justiça restaurativa. Trata-se de um método de solução de conflitos e também uma medida a viabilizar o acesso à ordem jurídica justa, complementando o papel do sistema jurisdicional. Tem abrangência internacional, especialmente a partir da Resolução 2.002/12 do Conselho Econômico e Social da ONU, documento que ajudou a globalizar este novo paradigma de resolução dos conflitos e a partir de então, esta metodologia se consolidou no Brasil como uma das portas de acesso à Justiça em seu sentido amplo. Após mais de dez anos das primeiras práticas restaurativas em Porto Alegre-RS, pode-se afirmar que a Justiça Restaurativa se constitui em um importante instrumento para a construção de uma justiça participativa, de modo a operar real transformação, com soluções compartilhadas, e em uma nova forma de promoção dos direitos humanos e da cidadania, da inclusão e da paz social com dignidade. Assim, diante deste contexto fático o presente estudo propõe a seguinte indagação: justiça restaurativa poderia contribuir para dar maior efetividade na resolução de conflitos dentro do ambiente escolar para prevenir e combater o bullying contra crianças e adolescentes? O referido trabalho irá apresentar o contexto histórico e conceitual do bullying escolar e suas nefastas consequências, também em relação a justiça restaurativa, algumas definições deste instituto, destacar princípios que fundamentam esta prática e por fim, demonstrar a eficiência desta metodologia como instrumento capaz prevenir e combater a violência do bullying contra crianças e adolescentes dentro do ambiente escolar.

Abstract
This article intends to reflect on the issue of bullying within the school environment and the paradigm of Restorative Justice as a possibility to prevent and combat this specific violence against children and adolescents. It is a transnational issue, considering that it is observed in practically every school in the world. In addition, as will be seen, the subject was the subject of scientific study, initially, from Sweden and Norway, in the latter, highlighting the researcher Dan Olweus. Likewise with regard to restorative justice. It is a method of resolving conflicts and also a measure to enable access to the just legal order, complementing the role of the judicial system. It has an international scope, especially since UN Economic and Social Council Resolution 2.002 / 12, which helped to globalize this new paradigm of conflict resolution and since then, this methodology has consolidated itself in Brazil as one of the access doors to Justice in its broadest sense. After more than ten years of the first restorative practices in Porto Alegre-RS, it can be affirmed that Restorative Justice constitutes an important instrument for the construction of a participatory justice, in order to operate real transformation, with shared solutions, and in a new way of promoting human rights and citizenship, inclusion and social peace with dignity. Thus, in view of this factual context, the present study proposes the following question: could restorative justice contribute to greater effectiveness in resolving conflicts within the school environment to prevent and combat bullying against children and adolescents? This work will present the historical and conceptual context of school bullying and its harmful consequences, also in relation to restorative justice, some definitions of this institute, highlight principles that base this practice and, finally, demonstrate the efficiency of this methodology as an instrument able to prevent and bullying violence against children and adolescents within the school environment.
