A IMPORTÂNCIA DA ATIVIDADE NOTARIAL E REGISTRAL: UMA ANÁLISE DA FUNÇÃO SOCIAL E DA EVOLUÇÃO NESTE ÂMBITO JURÍDICO

Resumo
O presente artigo, em primeiro momento, apresenta a forma de ingresso na atividade de notas e registros, que é delegada através de concurso público, assegurado pela Constituição Federal. As serventias extrajudiciais são órgãos instituídos pelo Estado, e em seu âmbito asseguram alguns princípios como a garantia do sigilo profissional, a fé pública, a segurança jurídica, a autenticidade e eficácia dos atos jurídicos, que reflete na presteza e eficiência que são ofertadas nas serventias extrajudiciais. Em segundo momento, faz-se a análise da função social que permeia o exercício notarial e registral, bem como a evolução nesse âmbito de atividade jurídica, em razão de a legislação reconhecer e abrir espaço para que as serventias possam servir de auxílio na prática de novos atos jurídicos, o que vem ora fazendo.

Abstract
The present article, in the first moment, presents the form of entrance in the activity of notes and registers, that is delegated by means of public contest, assured by the Federal Constitution. Out-of-court services are bodies established by the State, and in their scope they ensure certain principles such as the guarantee of professional secrecy, public faith, legal certainty, authenticity and effectiveness of legal acts, which reflects in the speed and efficiency that are offered in the services extrajudicial decisions. Secondly, the analysis of the social function that permeates the notarial and registry exercise, as well as the evolution in this scope of legal activity, due to the legislation recognize and open space so that the services can serve as aid in the practice of new legal acts, what has been doing now.
