Resumo
Este trabalho aborda temas polêmicos no campo do Direito Sucessório. Haja vista que atualmente busca-se a humanização do direito positivo, não somente no campo do Direito Civil, mas neste em especial, é reconhecido o fenômeno da repersonalização, que vem em substituição ao patrimonialismo da legislação anterior. Reflexo dessa tendência são os princípios da eticidade, socialidade e da operabilidade, que fundamentam o Código Civil de 2002. Para atender a estes postulados nosso legislador optou pela utilização das chamadas cláusulas gerais ou abertas, que visam permitir a adequação das disposições do Código à realidade social e para tanto exige-se tarefa cuidadosa do intérprete.

Abstract
This paper deals with controversial issues in the field of inheritance law. Considering that currently seeks to humanize the positive law, not only in the field of civil law, but this in particular is recognized in the phenomenon of repersonalization, which comes to replace the assets of the previous legislation. Reflecting this trend are the principles of ethics, sociality and operability, underlying the Civil Code of 2002. To meet these assumptions our legislature has called for the use of general clauses or open, which allow the adequacy of the provisions of the Code for social and for that it requires careful task of the interpreter.
