DIREITO EDUCACIONAL: UMA DISCUSSÃO TEÓRICA SOBRE A PRÁTICA JUS-EDUCACIONAL

Resumo
Este artigo é resultado de uma pesquisa teve início em 2007, e aborda o Direito Educacional sob a ótica do exercício dos direitos implícitos e explícitos nos seus documentos norteadores: Constituição Federal de 1988; LBD (Lei de Diretrizes e Bases da Educação), que traduz o exercício de deveres e direitos educacionais e documentos educacionais do nosso Estado, através do Sistema Estadual de educação (órgão executivo) e do Conselho Estadual de Educação (órgão consultivo). Busca-se sensibilizar a sociedade para a problemática pedagógica, considerando que o reconhecimento da tutela e a defesa de algum Direito Educacional precisam inserir-se na tipicidade da norma jus-educacional em defesa das partes presentes no processo ensino-aprendizagem. O artigo traz reflexões teóricas a partir da pesquisa bibliográfica, da análise das publicações na doutrina e no mundo acadêmico, e das legislações emanadas do poder público. O método hermenêutico, que visa à interpretação de leis, resoluções, portarias e a produção literária no mundo jurídico, contribuiu para esta produção. O nosso objetivo, com a sistematização e interpretação da legislação que ampara as relações jus-educacionais, é socializá-la com a comunidade regional e local envolvidas neste processo.

Abstract
This article is the result of a search began in 2007, and addresses the Education Law from the perspective of the exercise of implicit and explicit in its guiding documents. Constitution of 1988; LBD (Law of Directives and Bases of Education) which reflects the performance of duties and rights education and educational documents of our government, through the State System of Education (executive) and the State Council of Education (Advisory Body ). If the company seeks to sensitize the educational problem, whereas the recognition of guardianship and protection of any law must include education in the typical standard of jus-educational in defense of the parties in the teaching-learning process. The article offers theoretical reflections on the literature search, analysis of publications in literature and the academic world and the laws issued by the authority. The hermeneutic method, which aims at the interpretation of laws, resolutions, ordinances and legal literature in the world, contributed to this production. Our goal with the systematization and interpretation of legislation that seek refuge relations jus-education is to socialize it with regional and local community involved in this process.
