CLÁUSULAS GERAIS E CONCEITOS JURÍDICOS INDETERMINADOS: o poder criador dos juízes e a legitimidade democrática das decisões judiciais

Resumo
Este artigo tem como objeto as decisões judiciais amparadas pelo ativismo jurídico, pelas cláusulas gerais e pelos conceitos jurídicos indeterminados. Propõe-se analisar a legitimidade democrática de decisões judiciais que invadem a esfera de competência do Legislativo e do Executivo. Verifica-se que a transformação da sociedade determina a atualização dos paradigmas de direito, o que ocorre pelos precedentes jurisprudenciais e pelo exercício da interpretação constitucional das normas positivadas. Esse trabalho de interpretação constitucional, longe de ser simples subsunção da norma ao fato, origina o poder criativo do juiz. Será utilizado o método indutivo e de pesquisa bibliográfica, principalmente com pesquisa de doutrina nacional e estrangeira.

Abstract
This article is about the judgments supported by legal activism, the general clauses and the indeterminate legal concepts. Is proposed to analyze the democratic legitimacy of judicial decisions that encroach upon the powers of the Legislative and Executive. It is found that the transformation of society determines the update of the paradigms of law, which occurs by precedents and by the exercise of constitutional interpretation rules positivadas. This work of constitutional interpretation, far from simple subsumption of the standard actually causes the creative power of the judge. Will use the inductive method and literature, especially with research national and foreign doctrine.
