O DIREITO DOS REFUGIADOS AMBIENTAIS À LUZ DA CONSTITUIÇÃO DA REPÚBLICA FEDERATIVA DO BRASIL DE 1988

Resumo
O objeto do presente artigo científico é o estudo do direito dos Refugiados Ambientais à luz da Constituição da República Federativa do Brasil de 1988. Assim como os demais refugiados, os Refugiados Ambientais também se encontram fora do país de sua nacionalidade, no qual tinham sua residência habitual e em consequência de acontecimentos alheios à sua vontade, só que neste caso, são movidos por acontecimentos ambientais. Atualmente, sabe-se que o meio ambiente e seus desastres são um dos principais responsáveis pelas deslocações humanas. Por isso, a importância deste estudo sobre o direito dos Refugiados Ambientais, grupo vulnerável, cada vez mais comum nas sociedades contemporâneas. Ao longo do desenvolvimento do referido trabalho serão discutidas algumas questões, dentre elas: como os desastres ambientais estão envolvidos/ são os responsáveis pelo deslocamento deste grupo de pessoas; os aspectos gerais do termo “Refugiado Ambiental”; considerações sobre a utilização do termo “Refugiado Ambiental” ou “Deslocados Ambientais”; e por fim, o direito dos Refugiados Ambientais à luz Constituição da República Federativa do Brasil de 1988 e os princípios constitucionais que permeiam seus direitos. O método de abordagem a ser utilizado na elaboração desse trabalho foi o indutivo; o método de procedimento, o monográfico. O levantamento de dados foi através da técnica da pesquisa bibliográfica.

Abstract
The object of this scientific article is the study of Environmental Refugees law in the light of the Constitution of the Federative Republic of Brazil of 1988. Like the other refugees, Environmental Refugees are also outside the country of their nationality, in which they had their habitual residence and as a consequence of events unrelated to their will, but in this case, they are driven by environmental events. Nowadays, it is known that the environment and its disasters are one of the main causes of human displacement. Therefore, the importance of this study on the right of Environmental Refugees, a vulnerable group, increasingly common in contemporary societies. Along the development of this work will be discussed some issues, among them: how environmental disasters are involved / are responsible for the displacement of this group of people; the general aspects of the term "Environmental Refugee"; considerations about the use of the term "Environmental Refugee" or "Environmental Displacement"; and finally, the right of Environmental Refugees in light of the 1988 Constitution of the Federative Republic of Brazil and the constitutional principles that permeate their rights. The method of approach to be used in the elaboration of this work was the inductive one; the procedure method, the monographic one. The data collection was through the technique of bibliographic research.
