A JUSTIÇA RESTAURATIVA COMO MEIO PARA MANUTENÇÃO DA MENORIDADE PENAL

Resumo
O presente artigo científico tem como objeto a Justiça Restaurativa como meio para manutenção da menoridade penal. A crise no sistema prisional brasileiro é situação preocupante para todos aqueles que se interessam pelo Direito Penal pátrio. Não obstante os o crescimento do número de segregados registrados nas instituições de execução penal, a redução da maioridade penal, mostra-se como um movimento que tem recebido muitos adeptos no país. Nesse sentido, levando-se em consideração o cenário da segurança pública, faz-se necessário pensar em políticas sociais e instrumentos capazes de frear o desenvolvimento do crime e da violência, diferentes dos atualmente empregados, fadados ao fracasso. Desse pensamento de mudança adveio a Justiça Restaurativa com o escopo de alterar a forma com que o crime é tratado, formando uma relação entre, a vítima, o autor e a sociedade. O método utilizado na elaboração desse artigo foi o indutivo e o método de procedimento foi o monográfico. O levantamento de dados foi através da técnica da pesquisa bibliográfica. As Considerações Finais trazem em seu bojo aspectos mais relevantes ao tema.

Abstract
This scientific article has as its object Restorative Justice as a means to maintain the criminal minority. The crisis in the Brazilian prison system is a worrying situation for all those interested in national criminal law. Notwithstanding the growth in the number of segregated persons registered in criminal enforcement institutions, the reduction of the age of criminal responsibility is shown to be a movement that has received many supporters in the country. In this sense, taking into account the public security scenario, it is necessary to think about social policies and instruments capable of stopping the development of crime and violence, different from those currently used, doomed to failure. From this thought of change came Restorative Justice with the aim of changing the way crime is treated, forming a relationship between the victim, the author and society. The method used in the elaboration of this article was the inductive and the method of procedure was the monographic. The data collection was through the technique of bibliographic research. The Final Considerations bring in their core aspects most relevant to the theme.
