O RECONHECIMENTO DO DUPLO REGISTRO DE PATERNIDADE/MATERNIDADE: a forma de efetivação da multiparentalidade

Resumo

O presente artigo científico tem como objeto a análise quanto à possibilidade de reconhecimento do duplo registro de paternidade/maternidade como forma de efetivação da multiparentalidade. Inicialmente, promoveu-se a conceituação do instituto da multiparentalidade. Na sequência, destacou-se por meio do exame das jurisprudências que se tem até o momento da confecção deste artigo científico, como o duplo registro de paternidade/maternidade (biológico e socioafetivo), está sendo efetivado pelo Poder Judiciário, quando chamado a fazê-lo. Por fim, propôs-se a investigação acerca da decisão do RE 898.060/SC e da respectiva tese de repercussão geral fixada pelo Supremo Tribunal Federal no final do ano de 2016. O método de procedimento utilizado na elaboração desse artigo foi o indutivo e o método de procedimento foi o monográfico. O levantamento de dados foi através da técnica da pesquisa bibliográfica. As Considerações Finais trazem em seu bojo aspectos mais relevantes ao tema, bem como a comprovação ou não da hipótese básica.

Abstract

The present scientific article has as its object analysis to the possibility of the recognize the double registration of paternity / maternity as a form of effectiveness of multiparentality. Initially, the concept of a multiparentality institute was promoted. Subsequently, stood out examination of the jurisprudence that has been taken up to the moment of the preparation of this scientific article, such as the double registration of paternity / maternity (biological and socio-affective), is being carried out by the Judiciary when called to do so. Finally, it was then proposed to analyze the decision of RE 898.060/SC and the respective thesis of general repercussion fixed by the Federal Supreme Court at the end of 2016. The procedure method used in the elaboration of this article was the inductive one and the procedure method was the monographic one. The data collection was through the technique of bibliographic research. The Final Considerations bring in their aspects more relevant to the subject, as well as the proof or not of the basic hypothesis.
