ENSINO JURÍDICO E DIREITO ANIMAL: REPENSANDO A ATUAL CONDIÇÃO DOS ANIMAIS NÃO HUMANOS

Resumo
O Direito e seu ensino hodierno estão em um estado crítico. Marcado fortemente por traços formalistas, dogmáticos e conservadores, o Direito e sua prática parecem estar distantes dos anseios e realidade sociais. Para romper com esse estado é necessária uma abertura da academia para discussões e propostas que avancem o ensino e a prática jurídica no sentido de proporcionar maior interdisciplinaridade e compreensão da complexidade da vida e suas diversas manifestações. Nessa linha, pensar na instituição de uma disciplina, a nível de graduação, voltada especificamente para o estudo de questões envolvendo os direitos dos animais não humanos, com uma abordagem que favoreça o pensamento reflexivo, crítico e criativo, é uma possível alternativa. Com notória interdisciplinaridade, abarcando conteúdos de Direito, Filosofia, Biologia, Psicologia e outros, uma estrutura curricular que incentiva o desenvolvimento de um raciocínio integrativo e pautado na consideração dos interesses dos animais não humanos, a disciplina de Direito Animal proporcionaria o rompimento de paradigmas e preconceitos e reformulação da atual condição jurídica dos animais não humanos, qual seja, a de propriedade cujo valor é definido pelos humanos. Realizada tal reformulação, poder-se-ia passar dos discursos teóricos para a prática, onde os acadêmicos teriam a oportunidade não só de enriquecer sua visão acadêmica, como também exercer sua cidadania, sendo parte da transformação e aprimoramento sociais de sua comunidade, por meio de ações positivas na defesa e proteção dos interesses dos animais não humanos. O presente trabalho trata dessas questões e busca trazer a disciplina de Direito Animal como uma importante ferramenta para a mudança do pensamento jurídico e da sociedade no tratamento dos animais não humanos. O método de pesquisa utilizado foi o Indutivo, e as técnicas adotadas foram as da Pesquisa Bibliográfica e do fichamento

Abstract
Strongly marked by formalist, dogmatic, and conservative traits, law and its practice seem to be far from the social desire and reality. Break up with this state requires an opening of the academy for discussions and proposals that advance the teaching and legal practice in order to provide greater interdisciplinarity and understanding of the complexity of life and its various manifestations. In this line, thinking about the institution of a discipline, at the graduation level, specifically aimed at the study of issues involving the rights of non-human animals, with an approach favoring reflexive, critical and creative thinking, is a possible alternative. With a notorious interdisciplinarity, conjugating contents of Law, Philosophy, Biology, Psychology and others, a curricular structure that encourages the development of an integrative reasoning and guided in the consideration of the interests of non-human animals, the discipline of Animal Law would provide a paradigm and prejudices rupture and the reformulation of the current legal status of non-human animals, that is, property whose value is defined by humans. Once this reformulation was carried out, it was possible to move from theoretical discourse to practice, where scholars would have the opportunity not only to enrich their academic vision, but also to exercise their citizenship, being part of the social transformation and improvement of their community through positive actions in the defense and protection of the interests of non-human animals. The present work deals with these issues and seeks to bring the discipline of Animal Law as an important tool for changing legal and social thinking in the treatment of nonhuman animals. The research method used was the inductive, and the techniques were the bibliographic research and note taking.
