Resumo
O presente estudo estabelece a fundamentação constitucional e infraconstitucional do direito portuário brasileiro sob a ótica dos princípios constitucionais estabelecidos na legislação brasileira. Na seqüência, analisa-se a constitucionalidade da concessão da EMAP para administrar o Porto do Itaqui, localizado geograficamente na ilha de São Luis no Estado do Maranhão e ao final são analisadas as características da pessoa jurídica que administra o Porto. A análise do direito portuário visa refletir a sua importância para o desenvolvimento brasileiro.

Abstract
This study lays the foundation of constitutional law and infra Brazilian port from the perspective of constitutional principles established by Brazilian law. Subsequently, we analyze the constitutionality of granting the EMAP to manage the Port of Itaqui, geographically located on the island of Sao Luis in Maranhao State, and the final analyzes the characteristics of the legal entity that manages the Harbour. The analysis of the right port aims to reflect its importance to the development of Brazil.
