PARAMETRIZAÇÃO DO CONCEITO JURÍDICO DE VIABILIDADE ECONÔMICA COMO REQUISITO PARA RECUPERAÇÃO JUDICIAL DA EMPRESA

Resumo
O presente estudo tem como objetivo a análise dos pontos relevantes da estrutura da Recuperação Judicial, levando em consideração o princípio da viabilidade econômico-financeira. A partir da aprovação da Lei 11.101/2005 invalidando o Decreto-Lei n. 7.661/1945 foi criada a possibilidade da Recuperação Judicial, Extrajudicial, a falência do empresário e da sociedade empresária eliminando assim o instituto da concordata. Destarte para melhor compressão do surgimento da Recuperação Judicial no Direito Brasileiro, é necessária uma análise mais profunda das particularidades deste instituto, tendo-se que analisar desde os aspectos históricos da Recuperação Judicial à importância dele na sociedade empresarial. Assim, o presente trabalho, sem a pretensão de exaurir o assunto, objetiva analisar as modificações do legislador em relação à viabilidade econômica como requisito para recuperação judicial de empresa.

Abstract
The present study aims to analyze the relevant points of the structure of the Judicial Recuperation, taking into account the principle of financial- economic viability. Since the approval of Law 11.101/2005, which invalidating the Act n. 7.661/1945, it created the possibility of judicial and extra-judicial recovery of bankrupt companies thus eliminating the institution of bankruptcy. Thus better comprehension for the rise of Judicial Recuperation in Brazilian Law requires a deeper analysis of the peculiarities of this institute and it has to be analyzed from historical aspects of the Judicial Recuperation to its importance in the business society. Thus, the present study, without pretending to exhaust the subject, aims to analyze the modifications of the legislature in relation to economic viability as a requirement for judicial recuperation of enterprise.
