Resumo
Este trabalho propõe uma revisão bibliográfica acerca da legislação desportiva do Brasil e de Santa Catarina.A justiça desportiva foi institucionalizada na Constituição Federal de 1988, de forma definitiva. A Lei Zico, Lei n° 8.672/93 e a Lei Pelé, Lei n° 9.615/98, são leis de grande importância na matéria desportiva. O desporto tem os seus procedimentos administrativos regulados por dois códigos, o CBDF - Código Brasileiro Disciplinar do Futebol e o CBJDD – Código Brasileiro de Justiça e Disciplina Desportiva. A ação disciplinar desportiva consiste no procedimento adotado no caso de infração cometida por atletas ou entidades desportivas. A justiça desportiva brasileira processa e julga as infrações disciplinares e às competições desportivas, definidas nos códigos. A justiça desportiva não faz parte do Poder Judiciário, configurando-se órgão administrativo, dependente hierarquicamente do Ministério da Educação, Cultura e Desporto. O Poder Judiciário poderá admitir ações relativas à disciplina e às competições esportivas somente após se esgotarem as instâncias da justiça desportiva.O Estado tem o dever de estimular e promover a prática desportiva. As Confederações Esportivas são entidades superiores do desporto nacional, identificadas pela modalidade a qual regulam. Em Santa Catarina, o Sistema Desportivo Estadual é criado a partir da Lei n. 9.808, de 26/12/94.Por fim, o que se pretende é revisar a legislação desportiva aplicável no Brasil e em Santa Catarina.

Abstract
This paper proposes a literature review about the sports legislation of Brazil and Santa Catarina. The sporting justice has been institutionalized in the Constitution of 1988, definitively. The Zico Law, Law No. 8,672 / 93 and the Pelé Law, Law No. 9.615 / 98, are very important laws in the sport matter.Sport has its administrative procedures regulated by two codes, the CBDF - Brazilian Football Disciplinary Code and the CBJDD - Brazilian Code of Sports Justice and Discipline.The sports disciplinary action is the procedure adopted in the case of infraction committed by athletes or sports entities. The Brazilian sports justice processes and judges disciplinary infractions and sports competitions, as defined in codes. The sports justice is not part of the judiciary by setting up administrative body, hierarchically under the Ministry of Education, Culture and Sport. The judiciary may admit actions related to the discipline and sports competitions only after exhausting the instances of the sports courts. The state has the duty to encourage and promote sport. The Sports Confederation are higher than the national sports bodies, identified by mode which regulate. In Santa Catarina, the State Sports System is created from the Law n. 9808 of 12.26.94. Finally, the aim is to revise the sports legislation in Brazil and Santa Catarina.
