ASPECTOS DESTACADOS DA ARBITRAGEM: Uma análise legal e doutrinária

Resumo
Nesta pesquisa estudou-se o instituto da Arbitragem, inserido no contexto dos meios alternativos para solução dos conflitos de interesse, demonstrando-se os motivos que impulsionam a maior busca por estas formas extrajudiciais de solução dos conflitos, diante dos problemas enfrentados pela prestação jurisdicional. A partir dos primeiros dados colhidos já se percebem os motivos da adjetivação da Lei da Arbitragem, nº 9.307/1996, como moderna e eficiente, bem como sua sustentabilidade no atual sistema, tanto em tema de constitucionalidade (art. 5º, XXXV da CRFB), como em sua efetividade e natureza da derradeira decisão arbitral (art. 1º; inciso VII do art. 267; inciso IX e § 4º do art. 301; e art. 466-B todos do CPC). O trabalho mostra como os meios alternativos de solução dos conflitos são importantes para a diminuição das demandas judiciais, mas também demonstra a importante função social, pela maior participação e aproximação dos interessados na solução do conflito em busca da paz.

Abstract
This research studied the institute of the Arbitration, inserted in the context of alternative ways for solution conflicts of interest, demonstrating the reasons that stimulate the biggest search for these extrajudicial forms of conflicts solution, ahead the problems faced by the jurisdictional. From the first data collected is already realize the reasons for the adjective of the Law of Arbitration, nº 9.307/1996, as modern and efficient, as well as its sustainability in the current system, both in theme of constitutionality (art. 5º, XXXV of the CRFB), as its effectiveness and ultimate nature of arbitration (art. 1º; section VII of art. 267; section IX and § 4º of art. 301; e art. 466-B all of the CPC). The work shows how the alternative ways of conflicts solution are important for the reduction in litigation, but also demonstrates the important social function, the greater participation of interested and approach on resolving the conflict in search of peace.
