Resumo
O presente artigo tem como objetivo demonstrar as hipóteses em que o servidor público poderá ser demitido ou exonerado e ainda qual o juízo competente para as questões que se referem ao desligamento do mencionado profissional. Uma questão curiosa que aborda o presente artigo mostrará ao leitor se no direito administrativo existem as figuras da demissão com justa causa ou sem justa causa e exoneração com justa causa ou sem justa causa, eis que no direito do trabalho, no que tange “as demissões” são decorrentes as premissas “com ou sem justa causa”. Ademais, vislumbrar-se-á o conflito de competência existente entre a Justiça do Trabalho e a Justiça Federal, no que concerne ao artigo 114, inciso I, da Constituição da República Federativa do Brasil de 1988, em especial após a Emenda Constitucional no 45/2004 e a Ação Declaratória de Inconstitucionalidade - ADI no 3395. A metodologia utilizada neste estudo foi a pesquisa bibliográfica.

Abstract
