Resumo

O presente artigo versa sobre o negócio jurídico processual e a boa-fé como facilitadores da resolução de conflitos judiciais. Objetiva-se com o trabalho explorar noções introdutórias acerca dos referidos institutos e, a partir delas, verificar se existe uma relação entre o comportamento processual das partes e o autorregramento de vontades como instrumentos auxiliadores na resolução dos conflitos judiciais. Objetiva-se também, em segundo plano, contextualizar o negócio jurídico processual e a boa-fé no âmbito do CPC/2015. O método de abordagem utilizado foi o indutivo. O método de procedimento foi o monográfico. A técnica de pesquisa foi a bibliográfica. A conclusão do estudo, fundamentado este no direito material e processual civilista, demonstrou de fato existir interligação entre os institutos e vantagem na colaboração de ambos para solução de litígios e obtenção de melhores resultados aos envolvidos.

Abstract

The present article addresses the procedural legal business and the good faith as facilitators of judicial conflicts resolution. The objective of this paper is to explore introductory notions about these institutes and, from them, to verify if there is a relationship between the procedural behavior of the parties and the willingness agreement as tools to help in the resolution of judicial conflicts. It also aims, in the background, to contextualize the procedural legal business and the good faith within the scope of CPC/2015. The approach method used was the inductive one. The procedure method was the monographic one. The research technique was the bibliographic one. The conclusion of the study, based on the material and procedural civilist law, demonstrated in fact that there is interconnection between the institutes and advantage in their collaboration to resolve judicial conflicts and obtain better results for those involved.
