ATIVISMO JUDICIAL E REFLEXOS DA JUDICIALIZAÇÃO DA SAÚDE NO BRASIL

Resumo
O presente estudo objetiva analisar por meio a revisão da literatura a questão da judicialização da saúde apresentando as suas caraterísticas no âmbito jurídico brasileiro, visto que a judicialização da saúde é uma questão muito discutida e controversa, resultando em diversas opiniões entre os diferentes elementos ligados às áreas da justiça bem como da saúde. Muito embora existam diversificados canais à disposição dos magistrados, os mesmos ainda enfrentam inúmeras dificuldades em elação a tomadas de decisões, visto que não se trata somente de julgamento de um gasto a mais para o governo, em função de que a vida do ser humano encontra-se diretamente envolvida no processo. Além disso, conforme será demonstrado, a garantia de recursos permanentes para o financiamento da saúde e a redução das brechas de equidade, seja mediante a ampliação das fontes de financiamento bem como pela melhoria da eficiência na utilização dos recursos, serão sempre determinantes na busca de obter conquistas futuras que possibilitarão um processo de aproximação entre as perspectivas individuais e coletivas em matéria de direito a saúde

Abstract
The present study aims to analyze through the literature review the question of the judicialization of health presenting its characteristics in the Brazilian legal scope, since the judicialization of health is a very discussed and controversial issue, resulting in different opinions among the different elements related to areas of justice as well as health. Although there are diversified channels available to the magistrates, they still face numerous difficulties in relation to decision making, since it is not just a matter of judging an extra expense for the government, due to the fact that the life of the human being finds themselves directly involved in the process. In addition, as will be demonstrated, the guarantee of permanent resources for health financing and the reduction of equity gaps, either by expanding the sources of financing as well as by improving efficiency in the use of resources, will always be decisive in the search for obtain future achievements that will enable a process of approximation between the individual and collective perspectives on the right to health
